Since the creation of cryptocurrencies such as Bitcoin in 2009 and Ethereum in 2015, investors have created substantial wealth in the form of unrealized taxable gains on their crypto holdings. Gains on crypto are taxable as cryptocurrencies are deemed by the Commodity Exchange Act (CEA), Commodity Futures Trading Commission (CFTC) and Securities Exchange Commission (SEC) to be commodities and part of a commodity system and not treated as currencies. This tax-free re-investment is achieved by creating transaction-specific LLCs allowing LP investors to pledge crypto as collateral for loans financing the purchase of real estate assets.
